These Terms of Use (hereinafter "ToU") govern the use of the MasterX software and associated services offered by our company.

Use of the software implies full acceptance of these ToU. If you do not accept these terms, you must not use the software.

2. DEFINITIONS

• Software: MasterX, professional ECU tuning software
• User: Any natural or legal person using the software
• License: Right to use the software according to defined terms
• ECU: Engine Control Unit
• Tuning: Modification of engine control unit parameters

3. SERVICE DESCRIPTION

3.1 Main features

MasterX offers the following features:

• One-click IMMO OFF
• DPF, EGR, AdBlue, Swirl, TVA, Lambda deactivation
• Stage 1 to Stage 5 tuning
• Access to a database of over 65,000 ORI files
• Tuning solutions with photos and videos
• Professional technical support

3.2 License types

• Annual License: $399 per year (66% savings)
• Classic Lifetime License: $1,999 (lifetime access)
• Lifetime+ License: $3,999 (premium lifetime access)

3.3 File processing times

The following processing times are indicative and may vary depending on workload:

• Annual License: Up to 1 hour
• Classic Lifetime License: About 10 minutes
• Lifetime+ License: Absolute support priority

Important: These times are indicative and not absolute deadlines. If our team has a lot of maps to process, if our server is being updated, or if one or more of our employees are unavailable, this may delay the deadline. Any non-compliance with these rules is subject to potential sanctions.

4. CONDITIONS OF USE

4.1 Authorized use

The software is intended exclusively for professional use by qualified technicians in the automotive field.

4.2 Usage restrictions

It is strictly forbidden to:

• Use the software for illegal purposes
• Modify, decompile or reverse engineer the software
• Redistribute, resell or rent the software
• Use the software on vehicles without owner authorization
• Bypass security or authentication systems

4.3 User responsibility

The user undertakes to:

• Comply with regulations in force in their country
• Inform vehicle owners of modifications made
• Assume responsibility for modifications made
• Use the software in accordance with professional best practices

5. INTELLECTUAL PROPERTY

The MasterX software, its documentation, databases and all elements that compose it are protected by intellectual property rights.

Acquiring a license only grants a right of use and not ownership of the software.

6. DATA AND CONFIDENTIALITY

We are committed to protecting your personal data in accordance with our Privacy Policy.

Technical data collected during software use may be used to improve our services.

7. WARRANTIES AND LIABILITIES

7.1 Warranties

We guarantee that the software functions in accordance with its documentation under normal conditions of use.

7.2 Liability limitations

Our liability is limited to the amount paid for the license. We cannot be held responsible for:

• Direct or indirect damage resulting from use of the software
• Data loss or business interruptions
• Non-compliance with local regulations
• Damage caused to vehicles or equipment

8. REFUND POLICY AND LICENSE ACTIVATION

Activation period: A maximum period of 48 hours may be required to activate your license after purchase.

Refund conditions:

• During the 48-hour period before activation: No refund is eligible during this activation period.
• After the 48-hour period without activation: If your license has not been activated within this period, you may request a refund by contacting our customer service.
• After license activation: No refund is possible once the license has been activated, regardless of the formula chosen.

9. MODIFICATIONS

We reserve the right to modify these ToU at any time. Users will be informed of modifications by email or via the software.

10. APPLICABLE LAW AND JURISDICTION

These ToU are governed by French law. Any dispute will be submitted to the jurisdiction of the competent courts.
